All Progressive Congress (APC) Osun State Chapter has warned governor-elect in the state, Senator Ademola Adeleke to desist from dissolving the elected chairmen after his swearing-in as governor so as not to risk impeachment.
It was gathered that candidates of All Progressives Congress, APC, only participated in the October 15 local government election organized by Osun Independent Electoral Commission, OSIEC.
Fielding questions from journalists on the possible dissolving of the elected chairmen and councilors under the ruling party by the governor-elect, the chairmanship candidate for Ifelodun Local Government who doubles as Legal Adviser to Osun APC, Adegoke Ogunsola said no governor in Nigeria has the power to dissolve elected local government officers.
Ogunsola maintained that local government is a level of government, not an appendage of state government.
According to Ogunsola ” Governor of a state does not have the power to dissolve any elected member unless the court gives that particular nod that for certain reasons the governor could go ahead to dissolve or in the alternative, the house of assembly is an arm of government that could also give a resolution that may lead to the dissolution of local government.”
Ogunsola noted that for any governor dissolve elected local government it is an impeachable offence
While speaking on litigation filed by the Osun Peoples Democratic Party , PDP, against OSIEC on the legality of conducting the local government election, Ogunsola said as a law abiding citizen he would wait for the outcome of the case pending in Federal High Court of Osogbo.
